RENTAL AGREEMENT & TERMS AND CONDITIONS

These Rental Terms and Conditions (“Agreement”) govern all equipment, décor, furniture, linens, accessories, and other items (“Rental Property”) rented from PM Inspired LLC (“PM Inspired,” “we,” “us,” or “our”). By placing a rental order, paying a reservation deposit, electronically accepting these terms, signing a rental agreement, or taking possession of Rental Property, the customer (“Client”) acknowledges and agrees to these Terms and Conditions.

1. RENTAL ORDERS

All rental orders are subject to product availability and acceptance by PM Inspired.

The Client's invoice, quote, order confirmation, or rental order will identify the Rental Property, quantities, rental period, rental charges, applicable fees, and other transaction-specific information.

Rental Property is provided for temporary use only and remains the property of PM Inspired LLC at all times.

2. RESERVATION & NON-REFUNDABLE DEPOSIT

Unless otherwise stated in writing, a 50% non-refundable rental deposit is required to reserve Rental Property for the Client's event date.

Rental inventory is not considered reserved until PM Inspired receives the required deposit and any required acceptance of these Terms.

The reservation deposit will be applied toward the Client's total rental charges.

Because PM Inspired removes reserved inventory from availability for other customers, reservation deposits are non-refundable except where PM Inspired expressly agrees otherwise in writing.

3. FINAL PAYMENT

Unless otherwise stated on the Client's invoice, the remaining rental balance must be paid in full by the due date specified on the invoice.

No Rental Property will be released for pickup, delivered, or installed while an outstanding rental balance remains.

PM Inspired may cancel or withhold an order for failure to make required payments when due.

4. SECURITY DEPOSIT

PM Inspired may require a refundable security deposit based on the type, quantity, value, or nature of the Rental Property.

The security deposit is separate from the rental price and does not constitute payment toward the rental balance.

After Rental Property has been returned, counted, and inspected, the security deposit will be refunded in accordance with the applicable order terms, less any properly chargeable amounts for missing property, damage, excessive cleaning, late return, or other amounts owed under this Agreement.

The security deposit does not limit the Client's financial responsibility.

If charges resulting from loss, damage, non-return, cleaning, late return, or other obligations exceed the security deposit, the Client remains responsible for the remaining balance.

5. OWNERSHIP OF RENTAL PROPERTY

All Rental Property remains the sole property of PM Inspired LLC.

Payment of rental fees, security deposits, damage charges, or other fees does not transfer ownership of Rental Property to the Client unless PM Inspired expressly agrees to a transfer in writing.

The Client may not sell, pledge, pawn, sublease, abandon, dispose of, or otherwise claim ownership of Rental Property.

6. CLIENT RESPONSIBILITY

The Client assumes responsibility for Rental Property upon pickup or delivery and remains responsible until the property has been returned to and accepted by PM Inspired.

The Client agrees to use reasonable care to protect Rental Property from:

- Loss or theft
- Breakage
- Improper use
- Excessive staining or soiling
- Water or weather damage
- Fire or heat damage
- Unauthorized alterations
- Negligence
- Destruction
- Disappearance or non-return

Allowing another person, guest, employee, contractor, planner, decorator, venue representative, or transportation provider to possess or use Rental Property does not relieve the Client of responsibility under this Agreement.

7. INSPECTION AT PICKUP OR DELIVERY

Clients should inspect Rental Property at the time of pickup or delivery.

Any visible damage, incorrect quantity, or discrepancy should be reported to PM Inspired before the Rental Property leaves the pickup location or, for delivered orders, as soon as reasonably possible after delivery.

PM Inspired may document Rental Property through photographs, video, inventory records, checklists, or other reasonable means before release and following return.

8. PICKUP & RETURN

Rental Property must be picked up and returned at the dates and times specified on the Client's order or invoice.

The Client is responsible for providing an appropriate vehicle and safely transporting Client-pickup orders.

Unless otherwise agreed in writing, the rental period does not automatically extend because an event ends late or because the Client is unable to return the Rental Property at the scheduled time.

9. LATE RETURNS

Rental Property returned after the agreed return deadline may be subject to reasonable late-return or additional rental charges disclosed in the applicable order terms.

If a late return interferes with another reservation or requires PM Inspired to obtain substitute inventory, the Client may also be responsible for additional losses or costs to the extent permitted by applicable law.

PM Inspired's acceptance of a late return does not waive its right to collect applicable amounts owed.

10. LOST, STOLEN, MISSING OR UNRETURNED PROPERTY

The Client is responsible for all Rental Property placed in the Client's custody.

Rental Property that is lost, stolen, missing, destroyed, or not returned may be charged at the applicable replacement value stated on the Client's invoice, rental order, inventory schedule, or agreement.

Rental rates are charges for temporary use and do not represent the replacement value of the Rental Property.

Payment of a rental fee does not give the Client the right to retain Rental Property.

PM Inspired reserves the right to pursue lawful remedies to recover its property and/or amounts legally owed for unreturned property.

11. DAMAGE TO RENTAL PROPERTY

Normal wear resulting from proper use is expected.

The Client may be financially responsible for damage beyond ordinary wear, including breakage, burns, tears, permanent stains, structural damage, missing components, unauthorized modifications, or other damage occurring while the Rental Property is under the Client's responsibility.

When an item can reasonably be repaired, PM Inspired may charge reasonable repair costs.

When an item is destroyed, cannot reasonably be restored for continued rental use, or is not returned, the Client may be charged the applicable replacement value.

12. LINENS & FABRIC ITEMS

Linens and fabric Rental Property must not be cut, permanently altered, intentionally marked, burned, or subjected to materials reasonably likely to cause permanent damage.

Clients should not independently wash, bleach, dye, iron, or otherwise process rented linens unless PM Inspired specifically authorizes it.

Permanent stains, burns, tears, wax damage, or other damage beyond normal rental use may result in cleaning, repair, or replacement charges.

13. CLEANING

Standard post-rental cleaning may be included when expressly stated in the Client's order.

Additional cleaning charges may apply when Rental Property is returned in a condition requiring cleaning materially beyond ordinary post-event use.

Clients should remove personal property, trash, food, and other loose materials before returning Rental Property unless otherwise instructed.

14. DELIVERY

Delivery charges, when applicable, cover transportation according to the service specified in the Client's order.

Delivery does not automatically include setup, decorating, installation, breakdown, room flipping, or event cleanup.

These services must be specifically included in the Client's order to be provided.

The Client is responsible for providing accurate delivery information and reasonable access to the delivery location.

15. CLIENT PICKUP

For Client-pickup rentals, the Client is responsible for transportation and for appropriately securing Rental Property during transit.

PM Inspired may decline to release Rental Property when the proposed method of transportation creates a substantial risk of damage to the property or unsafe transportation.

16. SETUP & INSTALLATION

When setup or installation is purchased, PM Inspired will perform the services described in the applicable order.

Clients, guests, venues, or third parties should not move, dismantle, modify, climb on, or materially alter installed Rental Property in a manner inconsistent with its intended use.

Additional charges may apply when PM Inspired must perform work beyond the originally contracted scope.

17. OUTDOOR EVENTS & WEATHER

The Client assumes responsibility for providing a reasonably safe environment for Rental Property used outdoors.

Certain items may not be suitable for rain, high winds, extreme heat, unstable surfaces, or other adverse conditions.

PM Inspired reserves the right to decline or discontinue installation or use of Rental Property when conditions create a material safety risk or unreasonable risk of property damage.

18. CANCELLATIONS

Reservation deposits are non-refundable unless otherwise stated in writing.

Amounts paid beyond the reservation deposit will be handled according to the cancellation terms disclosed for the applicable order.

Requests to change an event date are subject to availability and PM Inspired's written approval. A requested date change does not guarantee that the originally reserved inventory will be available.

19. CHANGES TO ORDERS

Additions to rental orders are subject to availability and additional charges.

Reductions, substitutions, or removals requested after inventory has been reserved may be subject to the cancellation and payment terms applicable to the order.

Changes are not effective until confirmed by PM Inspired.

20. REPLACEMENT VALUES

Replacement values may vary by item and will be identified on the applicable invoice, rental agreement, inventory schedule, or other written order documentation.

The Client acknowledges that replacement values may be substantially greater than rental rates.

Replacement values are intended to reflect the applicable value associated with replacing lost, destroyed, or unreturned Rental Property and are not additional rental charges.

21. COLLECTION & ENFORCEMENT

If the Client fails to return Rental Property or fails to pay amounts properly due under this Agreement, PM Inspired may pursue remedies available under applicable law.

To the extent permitted by applicable law, the Client may be responsible for reasonable court costs, collection expenses, and other legally recoverable costs associated with enforcing the Client's obligations.

Nothing in this Agreement guarantees recovery of attorney's fees or other costs where such recovery is not authorized by applicable law.

22. SAFETY & PROPER USE

The Client agrees to use Rental Property only for its reasonably intended purpose.

Children should be appropriately supervised around Rental Property.

The Client must not use damaged or visibly unsafe Rental Property and should promptly notify PM Inspired if a safety issue is discovered.

23. LIMITATION OF RESPONSIBILITY

To the extent permitted by law, PM Inspired is not responsible for loss or damage to the Client's personal property resulting from the Client's or a third party's misuse of Rental Property.

Nothing in these Terms is intended to waive or limit any right or liability that cannot legally be waived or limited.

24. VENUE RULES & PERMISSIONS

The Client is responsible for confirming that the venue permits the Rental Property and services ordered.

The Client is also responsible for obtaining any permissions reasonably required by the venue for installation, decorating, loading, unloading, or removal.

Additional charges resulting from undisclosed venue restrictions, difficult access, delays, parking requirements, or other conditions may apply when agreed or otherwise permitted under the applicable order terms.

25. FORCE MAJEURE

PM Inspired will not be responsible for failure or delay caused by circumstances beyond its reasonable control, including severe weather, natural disasters, government restrictions, widespread transportation disruptions, utility failures, or other comparable events.

When such circumstances occur, PM Inspired will make reasonable efforts to communicate with the Client regarding available options.

26. GOVERNING LAW

This Agreement will be governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

Any provision determined to be unenforceable will be limited or severed to the extent necessary, and the remaining provisions will continue in effect to the extent permitted by law.

27. ENTIRE AGREEMENT

These Terms and Conditions, together with the Client's accepted quote, invoice, order confirmation, rental agreement, and any written modifications accepted by PM Inspired, constitute the agreement applicable to the rental transaction.

Transaction-specific terms shown on an accepted invoice or rental agreement may supplement these general Terms.

28. ACCEPTANCE OF TERMS

By signing a rental agreement, electronically accepting these Terms, paying the required reservation deposit after receiving these Terms, or taking possession of Rental Property, the Client acknowledges that they have had an opportunity to review and agree to the applicable rental terms.

CLIENT ACKNOWLEDGMENT

For rentals requiring a signed agreement, the Client will be asked to acknowledge the specific Rental Property, quantities, replacement values, security deposit, pickup/delivery information, and return deadline before Rental Property is released.
